CORPORATE & COMMERCIAL LAW

Commercial law pertains to those legal principles applied in the world of business and applies to persons and entities who are engaged in business and commercial transactions. Corporate law deals with those legal principles applicable to companies and other legal entities.

CONVEYANCING

Conveyancing is the transfer of legal title of real property from one person to another, or the granting of an encumbrance such as a mortgage or a lien. A typical conveyancing transaction has two major phases: the exchange of contracts (when equitable interests are created) and completion (also called settlement, when legal title passes and equitable rights merge with the legal title).

MEDICAL NEGLIGENCE

Medical Negligence refers to an unforeseen negative consequence of medical treatment that could have been avoided by a medical practitioner. South African medical law stipulates that the injury suffered must be due to the direct result of the medical practitioner’s actions or lack thereof.

HIGH & MAGISTRATES COURT LITIGATION

Cases involving personal injury claims below R400,000 are heard by Magistrates’ Courts. Cases involving higher claim amounts are heard by a High Court. A High Court also hears appeals against rulings by Magistrates’ Courts.

ESTATE PLANNING

Estate planning, simply put, is the process of arranging and managing your assets during your lifetime so that when you die, your estate is transferred in accordance with your wishes.

ADMINISTRATION OF DECEASED ESTATES

A deceased estate comes into existence when a person dies leaving property or a document which is a will or purports to be a will. Such estate must then be administered and distributed in terms of the deceased’s will or failing a valid will, in terms of the Intestate Succession Act, 81 of 1987.

ROAD ACCIDENT FUND CLAIMS

The Road Accident Fund (RAF) provides compulsory cover to all users of South African roads, citizens and foreigners, against injuries sustained or death arising from accidents involving motor vehicles within the borders of South Africa.

FAMILY LAW

Family law or matrimonial law incorporates family matters and domestic relationships such as marriage and civil unions, divorce and annulment, child custody and the best interests of the child, maintenance, child abuse and domestic violence.
